These Terms of Service (“Terms”) govern your access to and use of the website at getarcio.com (the “Site”) and the Arcio plugin for WordPress (the “Plugin,” together the “Service”), operated by Arcio, a sole proprietorship based in the Commonwealth of Massachusetts, United States (“Arcio,” “we,” “us,” or “our”). By installing, activating, or using the Service, you agree to be bound by these Terms. If you do not agree, do not install or use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Service. By using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Arcio is an AI-powered internal-linking tool for WordPress. The Plugin analyzes the post you select and sends the content over HTTPS to an Arcio relay endpoint, which forwards it to a third-party Large Language Model (currently Google Gemini) using our API key, and returns suggested internal links for your review. You do not need to provide your own API key.

Third-Party LLM APIs & No Data Storage by Arcio. Link suggestions are generated by third-party LLM APIs operated by their respective providers. Today, that provider is Google via the Gemini API; we may add Anthropic‘s Claude API as an alternative provider in the future. Your post content is held in Arcio’s relay memory only for the duration of the request. Arcio does not log, store, persist, or retain your post content, and does not use it to train any model. Standard webserver access logs (URL path, timestamp, IP, status code) are retained for security and abuse-prevention only and do not include request bodies. The selected LLM provider processes your content under its own terms, which apply in addition to these Terms:

By using the Plugin to run an analysis, you acknowledge that your post content is processed by the third-party LLM provider then in use, subject to that provider’s terms. If you do not agree to those terms, do not run an analysis. For full details of the data flow and our role as a data processor, see our Privacy Policy. You are solely responsible for reviewing and approving any suggestions before they are published.

3. Free Plan and Pro Plans

Free plan. The free version of the Plugin includes 10 AI analyses per calendar month per WordPress site. Unused analyses do not roll over. We may adjust the free-tier allotment with reasonable notice.

Pro plans. Pro plans provide higher monthly analysis allotments and additional features. Pro plan limits, pricing, and feature lists are presented at checkout and on the Pricing page. To unlock Pro features, you must complete a paid upgrade through Freemius (see Section 4) and accept Freemius’s checkout terms. Use of certain Pro features requires that you remain opted in to Freemius’s licensing system; if you opt out or your subscription lapses, those features will be disabled or downgraded to the free tier.

4. Payments & Freemius (Merchant of Record)

All paid transactions for the Plugin are processed by Freemius, Inc. as the Merchant of Record. By upgrading to Pro you enter into a separate agreement with Freemius governing payment, billing, taxes, and recurring renewals. Freemius’s terms and privacy policy are available at freemius.com/terms.

Freemius collects payment information directly; Arcio does not see, store, or process your full card details. Subscriptions renew automatically at the interval you selected at checkout until cancelled. You may cancel at any time from your Freemius customer portal; cancellation takes effect at the end of the current billing period.

5. All Sales Final — No Refunds

Because the Plugin invokes paid AI inference on third-party LLM providers as soon as you trigger an analysis, costs are incurred immediately upon use and we cannot recover them. Accordingly:

  • All sales are final. We do not offer refunds, prorated credits, or chargebacks for any Pro subscription, renewal, upgrade, or one-time purchase, whether or not the Plan has been used in the current billing period.
  • Try the free version first to confirm the Plugin works in your environment before upgrading.
  • You may cancel at any time to stop future renewals; cancellation does not entitle you to a refund of fees already paid.
  • This Section does not waive any non-waivable consumer-protection rights you may have under applicable law (for example, statutory withdrawal rights for EU consumers within 14 days of purchase, where the digital service has not yet been used). 6. Licenses & Intellectual Property

Free Plugin. The free version of the Plugin is distributed under the GNU General Public License, version 2 or later (GPLv2+).

Pro features. Pro features and any premium add-ons are licensed to you per the tier purchased through Freemius for use on the number of sites permitted by your plan. The license is non-exclusive, non-transferable, and revocable upon breach of these Terms or non-payment.

Trademarks & brand. The name “Arcio,” the Arcio logo, and the design of the Site are owned by Arcio. You may not use them without prior written permission, except as needed to refer to the Service.

Your content stays yours. You retain all rights to your WordPress content, posts, databases, and any output generated for your site by the Plugin. The Plugin operates locally on your WordPress server; we do not claim any ownership of, and do not have access to, your site’s data.

7. Acceptable Use

You agree not to:

  • Use the Service to generate or distribute content that is illegal, infringing, defamatory, harassing, deceptive, or that violates Google’s Generative AI Prohibited Use Policy.
  • Attempt to bypass, circumvent, or tamper with usage limits, license validation, or security mechanisms.
  • Reverse engineer, decompile, or extract source code from compiled Pro components, except to the extent expressly permitted by applicable law or by GPLv2+ for the free Plugin.
  • Resell, sublicense, or redistribute Pro features outside the scope of your purchased license.
  • Use the Service in a way that interferes with or imposes an unreasonable load on our infrastructure or that of our subprocessors.

8. Third-Party Services

The Service depends on third parties, including Freemius (billing and licensing), Google (Gemini LLM inference, and Google Analytics), and potentially Anthropic (Claude LLM inference) if added as an alternate provider in the future. Your use of the Plugin is also subject to those providers’ terms; current links are listed in Section 2 above and in our Privacy Policy. We do not control, and are not responsible for, third-party outages, pricing changes, policy changes, availability changes, or changes in model behavior. If a third-party provider becomes unavailable, changes its terms, or changes its pricing in a way that materially affects the Service, we may modify, suspend, or discontinue affected features without liability.

9. AI Output — No Warranty of Accuracy

AI-generated suggestions may be inaccurate, biased, incomplete, or otherwise unsuitable for publication. The Plugin returns suggestions, not finished content. You are solely responsible for reviewing every suggestion, fact-checking, and confirming that links and anchor text are appropriate before publishing. Arcio makes no warranty, express or implied, that AI output will be accurate, error-free, non-infringing, or fit for any particular purpose.

10. Privacy

Our handling of personal information, including the AI/LLM data flow and our subprocessors, is described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

You may stop using the Service and uninstall the Plugin at any time. We may suspend or terminate your access to Pro features (a) immediately for breach of these Terms, abuse, fraud, or non-payment, or (b) on reasonable notice for any other reason, such as discontinuation of the Service. Upon termination, your right to use Pro features ends; Sections that by their nature should survive (including Sections 5, 6, 9, 12, 13, 14, 15, and 16) will survive.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI OUTPUT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT IT WILL IMPROVE YOUR SEARCH RANKINGS OR TRAFFIC. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ARCIO’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO ARCIO (THROUGH FREEMIUS) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO THIS SECTION MAY NOT APPLY TO YOU IN FULL.

14. Indemnification

You agree to indemnify, defend, and hold harmless Arcio and its operator from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of (a) your use of the Service in violation of these Terms or applicable law, (b) content you publish using suggestions returned by the Plugin, or (c) your violation of any third-party right, including the terms of Freemius or Google.

15. Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Service shall be the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in those courts. Nothing in this Section deprives consumers of the protection of mandatory laws of their country of residence.

16. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the most recent revision. Material changes will be communicated by posting a notice on the Site and, where reasonable, by email to active license holders. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

17. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a sale, merger, or reorganization. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Arcio regarding the Service.
